根據《環(huan)(huan)(huan)境(jing)(jing)(jing)影(ying)響(xiang)評價法》第(di)26條(tiao)(tiao),建(jian)(jian)(jian)(jian)設(she)項(xiang)目建(jian)(jian)(jian)(jian)設(she)過(guo)程中(zhong),建(jian)(jian)(jian)(jian)設(she)單位(wei)應(ying)當同時實施環(huan)(huan)(huan)境(jing)(jing)(jing)影(ying)響(xiang)報告書(shu)、環(huan)(huan)(huan)境(jing)(jing)(jing)影(ying)響(xiang)報告表以及環(huan)(huan)(huan)境(jing)(jing)(jing)影(ying)響(xiang)評價文件審批部門審批意(yi)見中(zhong)提(ti)出的(de)(de)環(huan)(huan)(huan)境(jing)(jing)(jing)保(bao)(bao)護(hu)對策措施。《建(jian)(jian)(jian)(jian)設(she)項(xiang)目環(huan)(huan)(huan)境(jing)(jing)(jing)保(bao)(bao)護(hu)管理條(tiao)(tiao)例(li)》第(di)19條(tiao)(tiao),第(di)十(shi)九條(tiao)(tiao)編制(zhi)環(huan)(huan)(huan)境(jing)(jing)(jing)影(ying)響(xiang)報告書(shu)、環(huan)(huan)(huan)境(jing)(jing)(jing)影(ying)響(xiang)報告表的(de)(de)建(jian)(jian)(jian)(jian)設(she)項(xiang)目,其(qi)配(pei)套建(jian)(jian)(jian)(jian)設(she)的(de)(de)環(huan)(huan)(huan)境(jing)(jing)(jing)保(bao)(bao)護(hu)設(she)施經驗收(shou)(shou)合格(ge)(ge),方可(ke)投入生(sheng)產或者使用(yong);未(wei)經驗收(shou)(shou)或者驗收(shou)(shou)不合格(ge)(ge)的(de)(de),不得(de)投入生(sheng)產或者使用(yong)。即建(jian)(jian)(jian)(jian)設(she)項(xiang)目階段,環(huan)(huan)(huan)保(bao)(bao)責任主體為建(jian)(jian)(jian)(jian)設(she)單位(wei)。根據《排污(wu)(wu)許(xu)(xu)可(ke)管理條(tiao)(tiao)例(li)》第(di)17條(tiao)(tiao),排污(wu)(wu)單位(wei)應(ying)當遵守排污(wu)(wu)許(xu)(xu)可(ke)證規定,按照生(sheng)態環(huan)(huan)(huan)境(jing)(jing)(jing)管理要(yao)求(qiu)運行(xing)和維護(hu)污(wu)(wu)染防治設(she)施,建(jian)(jian)(jian)(jian)立(li)環(huan)(huan)(huan)境(jing)(jing)(jing)管理制(zhi)度,嚴格(ge)(ge)控(kong)制(zhi)污(wu)(wu)染物排放。建(jian)(jian)(jian)(jian)設(she)項(xiang)目投入生(sheng)產后成(cheng)為排污(wu)(wu)單位(wei),環(huan)(huan)(huan)保(bao)(bao)責任主體為持(chi)證的(de)(de)排污(wu)(wu)單位(wei)或排污(wu)(wu)登記(ji)申報的(de)(de)主體。
